PURPOSE:
To adopt a resolution approving a Quit Claim Deed to convey Parcel 21-A of Havasu Foothills Estates, Tract 2371.
BACKGROUND:
Havasu Foothills Estates Tract 2371 was recorded on October 4, 2005, at the Mohave County Recorder of Deeds, containing 26 lots zoned Residential Estate/Planned Development (RE/PD) and a Parcel A. The City was dedicated the approximately 3-acre Parcel A to accommodate the stormwater drainage through the Tract that serves the southeastern part of the Havasu Foothills Estates. The City subsequently approved a Parcel Plat amendment to Lot 21 of Tract 2371 to adjust the necessary lot grading in 2007 eliminating the need for a portion of the easement (0.21a), which was recorded creating Parcel 21-A, but a deed was not conveyed as intended following recording of this Parcel Plat.
Arizona Revised Statutes § 9-402 allows cities to convey real property owned by a city to the appropriate property owner without receiving payment for an easement that the City no longer needs. As Parcel A was dedicated to the City for drainage easement purposes, this Resolution authorizing execution of a Quit Claim Deed for Parcel 21-A will correct this past oversight.
