Adopt Resolution No. 24-3731 Approving a Government Agency Electronic Data Access Agreement with the Arizona Department of Transportation to Obtain Access to its Driver License Database (Bobbie Kimelton)

PURPOSE:

To approve an agreement allowing access to the Arizona Department of Transportation’s electronic data access to specified motor vehicle records and related information pursuant to the federal and state privacy protection statues set forth in 18 U.S.C. §§2721-2725 (Federal Driver’s Privacy Protection Act) and A.R.S. Title 28, Chapter 2, Article 5, and pursuant to permissible use(s) allowed in A.R.S. § 28-455.  The use of this information is determined to be necessary for public health and safety and is accessed in the City’s capacity as a government agency.

 

BACKGROUND:

This Agreement provides authorization for Lake Havasu City to access the Arizona Department of Transportation’s specified motor vehicle records and related information pursuant to federal and state statutes. By approving this Agreement the City is authorized to access the Department’s Motor Vehicle Records Request System to retrieve motor vehicle records information related to employment with Lake Havasu City. There are several reasons for requiring a driver’s license check on City employees. Checking driving records can help to ensure the safety of the employee, other employees and of the public. It can reveal if the employee has a history of reckless driving, DUIs or other serious offenses. In Arizona, the City is required to perform checks on all individuals applying for or currently possessing a commerical driver’s license. Checking driving records can help ensure the safety of the employee, other employees, and the public.  In addition, these checks are required for all drivers of City-owned vehicles to minimize risk and to manage insurance requirements.

I move to adopt Resolution No. 24-3731 approving a Government Agency Electronic Data Access Agreement with the Arizona Department of Transportation and authorizing the Human Resources Director to execute the Agreement on behalf of the City.
