PURPOSE:
To approve Cooperative Purchase Agreement 500461 and the purchase of a 2023 Caterpillar Excavator using OMNIA Partners’ Cooperative Purchase Agreement (CPA) with City of Tucson as the Lead Procurement Agency, and Empire Southwest LLC, dba Empire Machinery an authorized dealer of Caterpillar Inc., in accordance with City Code 3.10.101.3(A)(1).
BACKGROUND:
The Public Works Department is seeking approval to purchase a 2023 Caterpillar 308 Excavator through the City’s Cooperative Purchase Agreement 500461 under Omnia Partners City of Tucson contract number 212816-01. The purchase of this excavator was approved in the Fiscal Year 2023-24 budget and will replace units in the current fleet that have been identified by Vehicle Maintenance staff to be beyond its useful life and/or beyond repair.
COMMUNITY IMPACT:
The purchase of the excavator will provide the City with considerably less cost of repairs and downtime due to the age and condition of the others.
FISCAL IMPACT:
Funds of $172,588.76 (includes sales tax and freight) are allocated and available in the Fiscal Year 2023-24 HURF operations and capital budget.

SUGGESTED MOTION:Recommended action
I move to approve and authorize the City Manager to execute the Cooperative Purchasing Agreement with Empire Southwest dba Empire Machinery with a termination date of October 3, 2024; authorize City Staff to exercise the option to renew the Agreement for three (3) additional one (1) year terms; and authorize the purchase of a 2023 Caterpillar 308 Excavator in the amount of $172,588.76.
