PURPOSE:
To approve Amendment No. 2 to the Ground Lease Agreement with London Bridge Plaza, Inc., to include mobile food vendor regulations.
BACKGROUND:
Lake Havasu City entered into a Ground Lease Agreement with London Bridge Plaza in 2008 for its use of City-owned property (the London Bridge Plaza parking lot) for swap meet purposes. The Agreement was amended in May of 2009 (Amendment No.1) to revise the days and times of permitted use.
This Amendment No. 2 is proposed to include terms relating to compliance with the mobile food vendor regulations recently adopted by the City. The Amendment also includes some general clean-up of Section 13 of the Agreement. No changes are proposed to subsection 13(a); however, Amendment No. 1 made changes to subsection 13(d), but listed it as subsection 13(a), which is corrected in this proposed Amendment No. 2 to avoid any confusion in the future.
Staff recommends approval of this Amendment No. 2.
