PURPOSE:

Approve a multi-award for Job Order Cooperative Purchase Agreements utilizing Mohave County’s Job Order Contracts (JOC) No. 20PS19-01 through 20PS19-05 for Earthworks and Channel Maintenance and approve award of Job Order #1 for the Bridgewater Channel Dredging Phase 1 in accordance with City Code 3.10.010.3(A)(1).

 

BACKGROUND:

Lake Havasu City Public Works Street Department is seeking approval for a multi-award for Job Order Contracting (JOC) Cooperative Purchase Agreements for Earthworks and Channel Maintenance utilizing Mohave County’s JOC Contracts 20PS19-01 through 20PS19-05 with Desert Construction, Inc. (20P19-01), Lewis Equipment Services, LLC (20PS19-02), McCormick Construction Co. (20PS19-03), Perco Rock (20PS19-04), and Rummel Construction (20PS19-05).

 

Job Order Contracting is a unique, indefinite delivery, indefinite quantity procurement process that helps facility and infrastructure owners complete many repair, maintenance, renovation, and straightforward new construction projects through a competitively awarded contract.

 

Utilizing Mohave County’s cooperative purchasing program provides the City with a cooperative arrangement for acquiring goods or services that involves aggregating the demand of multiple entities to obtain a more economical purchase.

 

The multi-awarded contractors work will be performed through issuance of individual job orders during the term of the JOC.  Each individual job order, initiated by the City, is defined cooperatively by the City and awarded Contractors during the job order proposal process. Scope, schedule, price based on the contract’s fixed rate schedule, issuance of bonds, and amount of liquidated damages (if applicable) are agreed upon in a City approved individual Job Order prior to proceeding with the work after issuance of an executed Notice to Proceed.

 

The City will take appropriate care to ensure that the Contractor awarded the individual job order is controlling cost and labor efficiently, both while reviewing individual Job Order Proposals and when inspecting job sites. Each individual Job Order Proposal shall include a "Guaranteed Maximum Price (GMP)" or detailed fixed fee that the Contractor cannot exceed without prior written approval.

 

The maximum amount of an individual job order issued under the multi-award JOC cooperative purchase agreement will be $1,000,000 pursuant to A.R.S. § 34-605(F)(A).  The City Manager approves individual job orders up to $50,000.  The City Council awards individual job orders greater than $50,000.

 

The first Job Order will be for channel dredging.  The last time the Bridgewater Channel was dredged was 2010 when the Pima Wash Fan sediment was removed by dredging, and since then, sand and silt have again washed into the channel area and is gradually filling the channel making the navigable areas much smaller for the boat traffic.  One particular location, approximately 550’ south of the London Bridge, on London Bridge Beach has dramatically filled in, creating a pinch point.  This is a dangerous situation for boaters traveling through the channel and must remedied as soon as possible.  The City has plans to dredge the entire channel, however we have expedited the permitting for this area to dredge and remove the pinch point.  This Cooperative Agreement will allow us to meet the schedule included in our permit.

 

Other potential examples where this Cooperative Agreement will be used are emergency wash bank stabilization after a rainstorm and other wash maintenance throughout the year.    

 

Staff submitted a request for job order proposals to all seven (7) JOC contractors on the Mohave County JOC contractors list.  The City received one (1) Proposal from a qualified dredging contractor, Lewis Equipment Services, LLC. The single qualified proposal of $157,920.05 is fair and reasonable for the immediate work. We anticipate starting work with a Notice to Proceed date of Monday December 5, 2022, to complete all work by December 31, 2022.

 

COMMUNITY IMPACT:

Provide a safer beach environment for swimmers and improved channel navigation for the south end of the Bridgewater Channel.

 

FISCAL IMPACT:

Sufficient funds in the amount of $157,920.05 are available in the Fiscal Year 2022-23 Capital Improvement Plan Bridgewater Channel Dredging project utilizing funding from the General Fund.

I move to approve a multi-award cooperative job order contract purchase agreement utilizing Mohave County’s JOC Contracts for Earthwork and Channel Maintenance to Desert Construction, Lewis Equipment Services, LLC, McCormick Construction Company, Perco Rock, and Rummel Construction, Inc. and authorize the City Manager to execute said JOC cooperative purchase agreements and Job Order #1 to Lewis Equipment Services, LLC for the Bridgewater Channel Dredging Phase 1 in the amount $157,920.05.
