Approval of Master Rental & Sales Agreement with Rain For Rent™ for Rental of Equipment for Lift Stations (Mike Slettebo)

PURPOSE:
To approve the Master Rental & Sales Agreement with Rain For Rent™ for rental of equipment being used for North Point Lift Station due to indemnification requirement.
BACKGROUND:
The pump at the North Point Lift Station is not functioning and needs to be replaced. The malfunctioning is requiring Wastewater personnel to vactor the lift station at 2-hour intervals. Wastewater rented a trailer with a pump on it from Rain for Rent™ to keep the lift station functioning. The lead time for a new pump for this lift station is 8 to 10 weeks. It is necessary to continue to use the equipment from Rain for Rent™ until a new pump is installed in the lift station, which requires the execution of the Master Rental & Sales Agreement.
If pumps fail at other lift stations where the City does not have a working spare pump, this Agreement will provide the ability to rent necessary equipment from Rain for Rent™.
It is necessary for the City Council to approve this Master Agreement because it contains an indemnification clause requiring the City to hold harmless, indemnify, and defend Rain for RentTM.
COMMUNITY IMPACT:
The rental of the equipment from Rain for Rent™ keeps the community safe from a sewer spill at the North Point lift station.
FISCAL IMPACT:
Funds are available in the Wastewater Utility Fund (241.7630.52229).
