PURPOSE:
To introduce Ordinance No. 18-1189 amending Lake Havasu City Code Title 6, Animals, to make certain offenses civil and clarify animals in City parks.
BACKGROUND:
As Lake Havasu City Code Title 6 is currently written, the penalty for violation of any provision of this title is a charge of Class 2 Misdemeanor, unless otherwise provided. The purpose of this Council Communication is to change the penalty for violation of the following provisions to a civil offense rather than a Class 2 Misdemeanor:
• § 6.04.020 Dog License Required
• § 6.04.030 Dog License Fee
• § 6.04.050 Dog License Tag
• § 6.04.060 Refusing to Show License, Tag, or Proof
• § 6.08.010 Vaccination Requirements
• § 6.08.020 Proof of Vaccination
• § 6.12.010 At Large
• § 6.20.010 Dogs in City Parks - Additionally this section is recommended to be changed to Animals in City Parks to expand the definition to include all pets and other animals under the care, custody, or control of a park user.
• § 6.20.050 Dog Waste Removal - Additionally this section is recommended to be changed to Waste Removal to remove dog as the only animal to which this section applies.
COMMUNITY IMPACT:
Amending these sections of Lake Havasu City Code Title 6 more appropriately classifies violation of the identified offenses as civil rather than criminal.
