PURPOSE:
Approve Addendum No. 2 to Cellular Tower Lease Agreement with New Cingular Wireless PCS, LLC, extending the term an additional five (5) years in accordance with Section 1.2 of the Agreement.
BACKGROUND:
The Lessee and the City entered into a Cellular Tower Lease Agreement on March 27, 2012. The Agreement has been modified by Addendum No. 1 on March 31, 2014, to allow Lessee to make certain alterations to its equipment. The Agreement allows for three (3) additional five (5) year renewal periods; Addendum No. 2 will extend the period by five (5) years, terminating on March 31, 2022.
COMMUNITY IMPACT:
The City will continue to collect rent for the lease, and the cellular tower will provide enhanced cellular services to the Lessee’s customers in the community.
FISCAL IMPACT:
The City will receive $3,041.63 in rent per month; this amount will increase by 4% annually on April 1st per the Agreement.
