Ratify City Manager’s Execution of Access Easement Agreement with VRE English Village, LLC, for Vehicular and Pedestrian Ingress and Egress Adjacent to the Bridgewater Channel

PURPOSE:
Approve Access Easement Agreement for a non-exclusive easement for vehicular and pedestrian ingress and egress over VRE property located immediately adjacent to the Lake Havasu Bridgewater Channel seawall.
BACKGROUND:
In January of 2017, by Ordinance No. 17-1170, the City Council approved certain amendments to the general development plan for the English Village development. One of the conditions of approval of this Ordinance required VRE to enter into an easement agreement with the City regarding a 15-foot, non-exclusive pedestrian access easement along the channel adjacent to Phases II and III of the development.
This Access Easement Agreement satisfies the requirement of Ordinance 17-1170 and secures vehicular and pedestrian ingress and egress along the Bridgewater Channel. The vehicular access is limited to the City and its agents for the purpose of maintaining the bollards and chains along the channel.
COMMUNITY IMPACT:
This easement secures pedestrian access along the Lake Havasu Bridgewater Channel.
FISCAL IMPACT:
Ordinance No. 17-1170 commits the City to funding improvements to the cannon ball chains and bollards, and lighting within the easement area. Appropriation for the $42,076 lighting improvements is available in Account 110-7140-405.52-31. The estimated cost of the improvements to the cannon ball chains and bollards is $75,000 and appropriation will be identified when the actual costs are confirmed.
