PURPOSE:
Introduce Ordinance No. 16-1161 amending City Code to revise the definition of Service Animal.
BACKGROUND:
During the recent legislative session, House Bill 2255 was passed into law revising the definition of service animal in Arizona Revised Statutes § 11-1024, among other revisions. The previous state law and current City code, exempt from licensing fees trained service animals. The change in the law now specifically includes service animals in training into the prohibition of charging licensing fees.
The City’s definition of service animal in Chapter 6.04 is based on the state law definition. Therefore, it is necessary to amend the City’s definition to comply with and align to the revised state law.
