Introduce Ordinance 16-1160 Amending Lake Havasu City Code Title 14, Zoning, To Make Necessary and Minor Corrections to the Amendments Adopted June 28, 2016

PURPOSE:

Introduce ordinance recommending changes to Title 14, Zoning, to correct errors.

 

BACKGROUND:

Staff recently proposed several changes to the Development Code which were reviewed and adopted by Council on June 28, 2016. Due to the many changes, the process included a resolution identifying the changes as a public record which was then adopted by ordinance. Staff found a few mistakes within the public record which need to be corrected. The attached ordinance identifies the corrections proposed by staff.

 

The specific changes include:

 

                     Section 14.03.02 Permitted use table:

§                     Added “accessory swimming pool” as a use permitted in all districts (did not include Use Specific Standards column Section 14.03.03 E8 notation)

 

                     Section 14.04.01(A)(1), Table 4.01-1

§                     Minimum building front yard setback for R-UMS, R-CHD, and R-SGD add footnote (2) (added footnote in place of actual setback of 10 feet)

 

                     Section 14.04.07(B)(2)(c) remove “with the approval of the City or the owner of that easement, as applicable.” (incorrect section number was used)

 

                     Section 14.04.09(A)(5) add “Trash to be collected may be placed at the street right-of-way line on the assigned collection day for a period not to exceed 12 hours.”  (incorrect section number was used)

 

COMMUNITY IMPACT:

The Development Code protects and promotes the health, safety, and the general welfare of residents, and preserves and enhances the aesthetic quality of the City.
