PURPOSE:

To consider a Development Agreement for 90 lots on a portion of Trinity at Havasu Foothills Estates with MDCAB, LLC, regarding a sewer lift station, force main, and private roadways for the development and terminate the August 23, 2023, Development Agreement. 

 

BACKGROUND:

This Development Agreement outlines the developer’s responsibilities related to the installation and maintenance of the private lift station, private force main, and private roadways serving a portion of the development referred to as Trinity at Havasu Foothills Estates. 

 

The 90 lots that are on a portion of Trinity at Havasu Foothills Estates are included in the total permitted number of 697 lots for the entire Havasu Foothills Estates area.

 

The City and MDCAB, LLC, entered into a Development Agreement dated August 23, 2023, for Tract 2391 (24 lots out of 90 lots), but since that time the developer decided to make all the roadways within the development private.  If the proposed Development Agreement is approved, it will be necessary to terminate the August 23, 2023, Development Agreement. 

 

The new/replacement Development Agreement and August 23, 2023, Development Agreement are provided as attachments.
