PURPOSE:
To consider the introduction of an ordinance amending City Code § 10.20.040, Violation-Penalty-Nuisance, regarding off-road motorized vehicles.
BACKGROUND:
It was recently discovered that City Code Section 10.20.040, containing the violation and penalty provisions for Chapter 10.20, Off-Road Motorized Vehicles, refers to City Code Chapter 3.20 for fines, but Chapter 3.20 does not contain such fines.
The proposed ordinance revises Section 10.20.040 to clarify that a violation of Chapter 10.20 is a civil offense and refers to Chapter 1.12 for enforcement. Chapter 1.12, Code Compliance, provides a uniform code compliance process and penalties to address code violations.
