PURPOSE:
To consider adopting Resolution No. 26-3902 approving the Delegation Agreement No. EV26-0095 with the Arizona Department of Environmental Quality (ADEQ) for delegation of authority to issue open burn permits.
BACKGROUND:
Under this agreement, the Arizona Department of Environmental Quality (ADEQ) is delegating to Lake Havasu City the authority to issue open burn permits. This transfer of responsibility empowers the City to administer and manage the open burn permitting process in accordance with ADEQ standards. By entrusting Lake Havasu City with this role, ADEQ seeks to streamline the permitting process, provide quicker, more localized service to residents, and ensure strict compliance with state air quality regulations. This is specifically for permits on private property for the burning weeds and brush.
COMMUNITY IMPACT:
ADEQ’s delegation provides Lake Havasu City with the delegated function and duties regarding the issuance of open burn permits.
FISCAL IMPACT:
Funds are allocated and available in the Fiscal Year 2025-26 Fire Department Budget within the Fire Prevention Division as part of its administrative duties.
