PURPOSE:
To consider an Agreement for Percheron Estates Subdivision with Colt Estates Homeowner Association, regarding private roadways and drainage for the development.
BACKGROUND:
The property known as Percheron Estates, Tract 2405, consists of 4.38 acres and four residential lots, and is zoned Residential Estates. The development is served by public water, private septic systems, private roadways, and private drainage facilities.
Because the subdivision relies on private roadways and drainage, the homeowners association must enter into an Agreement to define its responsibilities for maintaining these improvements. The Agreement outlines the homeowners association’s obligations for ongoing maintenance of the private roads and drainage infrastructure.
The subdivision has been developed, and 2 of the 4 lots currently contain single-family homes. A similar Development Agreement for this subdivision was approved by City Council on February 23, 2021; however, the agreement was never executed. City staff recently identified this oversight, prompting the need for the current request.
