PROPERTY AND APPLICATION BACKGROUND:
The property is part of a State Trust lease for the Island Inn. The proposed location of the conditional use permit is along the beach adjacent to the City Park London Bridge Beach. This is the same location where Whetrods and Champion Rentals jet ski conditional use permit was granted in 2010. In 2010, the Arizona State Trust authored a letter authorizing the allowance of this use as an accessory use under the current development plan on file for the property.
At the hearings in 2010, the Commission discussed the following points:
· Location of kiosk (portable building)
· Reservation of parking spaces
· Removal of temporary structures
· Signage (limited to 30 square feet)
· Directional signs, not allowed in the park
· No temporary signs including, American flag, pennants and other blade banners
· Beach area to be encumbered by accessory stuff, chairs, tables, shade structures, etc.
As a result of the discussion, the following conditions were placed on the conditional use permit by the commission.
1. The proposed structures shall not be located on State Beach property.
2. All temporary land based structures shall be removed during the off-season. (November 1st to February 29th)
3. Two parking spaces (one for each vendor) will be reserved within the park for a business vehicle. All other vehicle associated with the business shall park in the Island Inn hotel parking lot.
4. No other signage including directional signage shall be allowed on the site or in the park other than the signage on the kiosk.
The applicants, Nicolas and Mistie Rius, have been operating the business in this location for the past 30 days under a temporary use permit until the Commission had the opportunity to review the proposed conditional use permit. Since the letter of intent and the site map are not very descriptive, staff has used the 2010 approvals as a basis for providing the commission with suggested conditions of approval.
Staff reviewed the information provided and believes many of the original conditions are still appropriate and recommend the following.
· Address vehicle parking by limiting business to one reserved space within the existing parking lot.
· Address signage by allowing no more than 30 square feet of sign the majority of which should be placed at the intersection of McCulloch and Sir Peter Studd. Prohibiting directional signs in the park. Prohibiting temporary signage such as blade banners and pennants.
· Address limiting temporary building to one and size to no greater than 120 square feet (10x12)
· Address seasonal removal of land based structures (Nov. 1st through February 29th )
· Limit beach area coverage to no more than 300 square feet for accessory items such as chairs, tables, and shade structures.
· Prohibit the launching of any watercraft from the location.
· Prohibit fuel storage or re-fueling of equipment from the location.

STAFF RECOMMENDATIONS:
Staff recommends the Commission approve conditional use permit 15-0256 with the following conditions.
1. One parking space shall be reserved for the business within the existing parking lot.
2. No more than 30 square feet of total signage allowed. The majority of signage should be placed at the intersection of McCulloch and Sir Peter Studd Drive on Island Inn property. Directional signs and temporary signage such as blade banners and pennants shall be prohibited.
3. Temporary buildings shall be limited to one and shall be no greater than 120 square feet (10x12)
4. All temporary structures/buildings shall be removed by Nov. 1st through February 29th
5. Beach coverage shall be limited to no more than 300 square feet for accessory items such as chairs, tables, and shade structures.

SUGGESTED MOTION::Recommended Action
I move to approve application 15-0256 with the following conditions;
