PROPERTY AND APPLICATION BACKGROUND:
The Commission held a hearing on this item on June 17, 2015, and voted to table the item until the July 1, 2015, meeting. Several individuals spoke regarding the proposed activity. Comments ranged from previous requirements of past conditional use permit holders, dangers of boats to current business practices and insurance requirements. One question posed by commission members was if the proposed location was appropriate for this type of activity. Kelly Garry explained that the location was a private beach, unlike public beach located in the area such as London Bridge Beach and Rotary. Further, through an environmental review process conducted by the BLM, this location was determined not only appropriate, but could accommodate two vendors of this type.
The property is part of a State Trust lease held by the Island Inn. The proposed location of the conditional use permit is along the beach adjacent to the City Park - London Bridge Beach. This is the same location where Whetrods and Champion Rentals obtained and operated under conditional use permits granted in 2010. In 2010, the Arizona State Trust authored a letter authorizing this use as an accessory use under the current development plan on file for the property.
At the hearings in 2010, the Commission discussed the following points:
· Location of kiosk (portable building)
· Reservation of parking spaces
· Removal of temporary structures
· Signage (limited to 30 square feet)
· Directional signs, not allowed in the park
· No temporary signs including, American flag, pennants and other blade banners
· Beach area to be encumbered by accessory stuff, chairs, tables, shade structures, etc.
The applicants, Nicolas and Mistie Rius, have been operating the business in this location for the past 30 days under a temporary use permit until the Commission had the opportunity to review the proposed conditional use permit. Since the letter of intent and the site map are not very descriptive, staff has used the 2010 approvals as a basis for providing the commission with suggested conditions of approval.
Staff reviewed the information provided and the minutes of the June 17 agenda and recommend the following:
· Address the potential boat/swimmer conflict by limiting the business to no more than two boats for rent and limit them to the furthest western beach area away from the designated swim area.
· Address signage by allowing no more than 30 square feet of sign the majority of which should be placed at the intersection of McCulloch and Sir Peter Studd. Prohibiting directional signs in the park. Prohibiting temporary signage such as blade banners and pennants.
· Address seasonal removal of land based structures (Nov. 1 through February 29).
· Limit beach area coverage to no more than 300 square feet for accessory items such as chairs, tables, and shade structures.
· Limit the jet skis to no more than 14 and restrict their location to a 50 foot stretch of beach anchoring them 7 by 7.
· Prohibit the launching of any watercraft from the location.
· Prohibit fuel storage or re-fueling of equipment from the location.

STAFF RECOMMENDATIONS:
Staff recommends the Commission approve conditional use permit 15-0284 with the following conditions.
1. No more than 30 square feet of total signage allowed. The majority of signage should be placed at the intersection of McCulloch and Sir Peter Studd Drive on Island Inn property. Directional signs and temporary signage such as blade banners and pennants shall be prohibited.
2. Temporary buildings shall be limited to one and shall be no greater than 120 square feet (10x12).
3. All temporary structures/buildings shall be removed by Nov. 1 through February 29.
4. Beach coverage shall be limited to no more than 300 square feet for accessory items such as chairs, tables, and shade structures.
5. Limit the jet skis to no more than 14 and restrict their location to a 50 foot stretch of beach anchoring them 7 by 7.
6. Launching of any watercraft from the location shall be prohibited.
7. Fuel storage or re-fueling of equipment from the location shall be prohibited.
SUGGESTED MOTION::Recommended Action
I move to approve application 15-0284 with the following conditions;
1. No more than 30 square feet of total signage allowed. The majority of signage should be placed at the intersection of McCulloch and Sir Peter Studd Drive on Island Inn property. Directional signs and temporary signage such as blade banners and pennants shall be prohibited.
2. Temporary buildings shall be limited to one and shall be no greater than 120 square feet (10x12)
