PURPOSE:
To consider approval of a License Agreement to maintain, repair, upgrade and improve parcels for the purpose of erecting and maintaining restroom buildings, erecting and maintaining trash/grease enclosures, and installing and maintaining landscaping and pedestrian walkways with London Bridge Plaza, Inc. The Agreement is related to use of two parcels of City property located generally at 1530 Paseo Del Sol Avenue and 306 London Bridge Road.
BACKGROUND:
The previous item on this agenda discussed by the City Council involved consideration of the sale of a City-owned roadway, Parcel J of Block 8 of Tract 2183 a 20-foot-wide, 100-foot-long strip located between Lots 4 and 5, both of which are owned by the same individual. The owner of the adjacent lots approached the City and London Bridge Plaza, Inc., which holds a License Agreement with the City covering the subject parcel, to work out an arrangement among all parties for the potential purchase of Parcel J, which currently contains a restroom facility.
Because Parcel J is included in the existing License Agreement, it needs to be removed from the Agreement before any sale occurs. This also provided an opportunity to update the License Agreement, which has been in place since 1998. Following discussions among the parties, the President of London Bridge Plaza, Inc., agreed to and signed the updated License Agreement.
Under the updated Agreement, the City grants the Licensee a non-exclusive license to maintain, repair, upgrade, and improve Parcels D and L for the purpose of erecting and maintaining public restroom buildings, erecting and maintaining trash/grease enclosures, and installing and maintaining landscaping and pedestrian walkways. Parcel L is currently developed with a restroom building, while Parcel D is improved with landscaping.
The purchaser of Parcel J and London Bridge Plaza, Inc., are working privately to establish an arrangement regarding restroom facilities as part of any future development involving the parcel.
