Discussion and Possible Direction: Request for Qualifications Process (Councilmember Campbell, Kelly Garry, City Attorney)

PURPOSE:

Discussion and possible direction regarding the Request for Qualifications (RFQ) process.

 

BACKGROUND:

At the March 24, 2026, City Council meeting, Councilmember Campbell requested a follow-up item to further discuss the RFQ process.

 

Following the March 10, 2026, City Council meeting item, and after further discussion and clarification, it was determined that with the next RFQ process, City staff will include in the Council agenda packet a summary of the evaluation rankings at the time the contract is brought before Council for consideration of award/approval (in contrast to Council approving the evaluation rankings before negotiations of a contract begins).  Attached is a sample Selection Committee Evaluation Summary Tabulation for reference. 

 

If Council has specific questions or concerns about the evaluation process, Council can at the meeting vote to adjourn into executive session to discuss.  This process preserves the confidentiality of each firm’s statement of qualification while supporting a fair, competitive and transparent selection process.    

 

The following items are proposed at this time for City Council’s discussion, consideration, and direction:

 

1)                     To create a requirement of the City that a selection committee required under Arizona Revised Statutes § 34-603 must contain at least one outside contractor, architect, or engineer.

2)                     The City staff to issue a notice of interest to solicit contractors, architects, or engineers interested in serving on a selection committee. 

 

Under Arizona Revised Statutes § 34-603, the members of a selection committee may be employees of the City or outside consultants.  Also, under the state statute, outside contractors, architects and engineers serving on a selection committee shall not receive compensation from the City for performing this service, but the City may elect to reimburse outside contractors, architects and engineers for travel, lodging and other expenses incurred in connection with service on a selection committee. A person who is a member of a selection committee shall not be a contractor under a contract awarded under the procurement or provide any professional services, construction, construction services, materials or other services under the contract.

I move to direct City staff to create a requirement that a selection committee required under Arizona Revised Statutes § 34-603 must contain at least one outside contractor, architect, or engineer and further direct City staff to issue a notice of interest to solicit contractors, architects, or engineers interested in serving on a selection committee.
