COUNCIL COMMUNICATION

TO:                                          Honorable Mayor and Council

FROM:                     Jeff Thuneman, Development Services Director

SUBJECT:Title

Action: Resolution No. 24-3786 Accepting Dedication of Right-of-Way at the Southwest Corner of Tract 0000, Block 4, Lot 30, 7000 Chenoweth Drive (0.24 Acres), from SR95 Storage, LLC, (Chris Gilbert)

Body

FUNDING SOURCE:

N/A

PURPOSE:

To adopt a resolution accepting dedication of right-of-way at the southwest corner of 7000 Chenoweth Drive.

BACKGROUND:

The property owner of a storage unit development in progress at 7000 Chenoweth Drive is dedicating 0.24 acres of property to the City for future City improvements and maintenance.  A copy of the application and the surveyed legal description and drawings are attached.  This right-of-way is requested by the City as Chenoweth Drive’s current location is partly on the southwest corner of the owner’s property, leaving no room for future City improvements or maintenance activities.  As other properties develop in both directions from 7000 Chenoweth and as the State-owned property to the south is sold to new owners, additional rights-of-way will be acquired as necessary to ensure the City can provide improvements and street maintenance services along Chenoweth in the future.

All outside utilities participated in the review and the only comment received was from the City Public Works Water Utility Division that any relocation necessary of fire hydrants or water service lines and meters will be at the property owner’s expense.

COMMUNITY IMPACT:

Having the necessary right-of-way to provide proper improvements and ongoing maintenance services to City streets is an important function provided by the City.

FISCAL IMPACT:

Minimal fiscal impact is expected from the dedication.
