PURPOSE:
To consider the introduction of an ordinance amending City Code Title 6 adding and revising definitions, revising violations, and adding Unlawful Restraint of Dog and Animal Hoarding sections.
BACKGROUND:
Title 6, Animals, of the City Code was recently reviewed to determine if revisions were needed. Staff recommends amendments to Title 6 as shown on the attached Tracked Changes document.
Generally, the suggested changes include:
1) Adding and revising definitions used in the Title;
2) Updating and revising violations throughout the Title to revise fees, specify civil or criminal offenses; tier certain violations; and added probation as a possible penalty.
3) Cruelty to Animals (Section 6.16.010) was revised to include three additional actions included in state law;
4) Unlawful Restraint of Dog was added as a new section (Section 6.16.030) replacing Tethered Animals section;
5) Clarified an owner or any person keeping, possessing, harboring or maintaining an aggressive animal may be guilty under Aggressive Animals (Section 6.16.040); and
6) Animal Hoarding was added as a new section (Section 6.20.070).
COMMUNITY IMPACT:
Updating regulations to ensure best practices and address current needs.
