Action: Resolution No. 24-3794 Adopting the Lake Havasu City Airport Disadvantaged Business Enterprise Program (Robert C. Kane)

PURPOSE:

To consider adoption of a resolution adopting the DOT and FAA-mandated Disadvantaged Business Enterprise (DBE) program.

 

BACKGROUND:

On April 9, 2024, the U.S. Department of Transportation (DOT) published the Disadvantaged Business Enterprise (DBE) Final Rule Changes (effective May 9, 2024). The goal of these changes is to modernize and strengthen DBE programs including those under the Federal Aviation Administration (FAA).

 

49 CFR Part 26 requires FAA recipients receiving grants for airport planning or development that will award prime contracts of $250,000 or more in FAA funds in a fiscal year to have a DBE program. The purpose of the DBE program is to ensure nondiscrimination in the award and administration of DOT-assisted contracts. To comply with federal regulations, the Lake Havasu City Airport must implement the DBE program by creating a DBE program, setting a goal methodology on a triennial basis, and completing an annual DBE Uniform report every fiscal year that federal funds were expended.

 

Lake Havasu City Airport and City staff, with assistance from C&S Engineers’ program experts, developed a suitable DBE program with a recommended goal methodology as required by the FAA. The recommended overall goal for the three-year Fiscal Year 2025-27 period is 9.15%.

 

COMMUNITY IMPACT:

The purpose of the program is to ensure DBEs have an equal opportunity to participate in federally assisted projects at the Lake Havasu City Airport.

 

FISCAL IMPACT:

The Airport Enterprise Fund will have an annual cost of approximately $5,000 for C&S Engineers’ assistance for maintaining, monitoring and reporting on the DBE program.
