Action:  Resolution No. 25-3800 Adopting the Revised Lake Havasu City Airport Disadvantaged Business Enterprise Program and Repealing Resolution No. 24-3794 (Robert C. Kane)

PURPOSE:

To consider adopting a resolution adopting the revised U.S. Department of Transportation (DOT) and Federal Aviation Administration (FAA)-mandated Disadvantaged Business Enterprise (DBE) program.

 

BACKGROUND:

Lake Havasu City staff, with assistance from C&S Engineers’ program experts, developed a suitable DBE program with a recommended goal methodology as required by the Federal Aviation Administration (FAA). Council approved Resolution No. 24-3794 on November 12, 2024, adopting a DBE plan and recommended overall goal for the three-year Fiscal Year (FY) 2025-27 period of 9.15%. The plan and goal methodology were submitted to the FAA for approval. Based on the FAA’s recommended changes, the plan has been revised with a new recommended overall goal for the three-year FY 2025-27 period of 14.5%.

 

49 CFR Part 26 requires FAA recipients receiving grants for airport planning or development that will award prime contracts of $250,000 or more in FAA funds in a fiscal year to have a DBE program. The purpose of the DBE program is to ensure nondiscrimination in the award and administration of DOT-assisted contracts. To comply with federal regulations, the Lake Havasu City Airport must implement the DBE program by creating a DBE program, setting a goal methodology on a triennial basis, and completing an annual DBE Uniform report every fiscal year that federal funds were expended.

 

COMMUNITY IMPACT:

The purpose of the program is to ensure DBEs have an equal opportunity to participate in federally assisted projects at the Lake Havasu City Airport.

 

FISCAL IMPACT:

The Airport Enterprise Fund will have an annual cost of approximately $5,000 for C&S Engineers’ assistance for maintaining, monitoring, and reporting on the DBE program, which will be included in each annual budget.

SUGGESTED MOTION:

I move to adopt Resolution No. 25-3800 adopting the revised Lake Havasu City Airport DBE Program, authorizing the City Manager to execute the policy statement on behalf of the City, and repealing Resolution No. 24-3794.
