PURPOSE:

To consider adoption of an ordinance amending City Code Section 3.20.040 to establish new fees related to pavement restoration, update City costs recovered for utility permits, and revise fees for special event street closures and police and fire services.

 

BACKGROUND:

The Council recently amended City Code Chapter 11.10.030, Location and Relocation of Facilities in Public Rights-of-Way. As a part of this effort, the Public Works Department conducted a market analysis to determine appropriate fees related to pavement restoration within public rights-of-way. The attached fee schedule outlines the proposed pavement restoration fees and includes an adjustment to the Utility Permit cost-recovery rate, increasing it from the current 13% to full cost recovery.

 

To support event promoters who bring the community together and contribute to the local economy, the City has established a fixed rate for the closure of McCulloch Boulevard. This fixed rate provides clarity and predictability for event organizers by outlining the costs associated with using the downtown corridor. After reviewing fee structures from comparable cities, staff proposes a closure rate of $1,500 for the closure of McCulloch Boulevard from Acoma Boulevard to Smoketree Avenue. An additional closure fee of $500 would apply for closures extending from Smoketree Avenue to Riviera Drive. This additional fee was calculated based on the proportional distance, as this segment represents approximately one-third of the total length from Acoma Boulevard to Smoketree Avenue. This standardized fee structure ensures transparency, consistency, and affordability for future event promoters while supporting continued community engagement in the downtown area. Please note, the unit of measure for street closures on McCulloch was changed from what was presented at the introduction. To account for the multiple-day events that require the street to stay closed for the duration of the event, the fee was changed from “per day” to “per closure”, as staff would only be closing the street once.

 

Due to State and City posting requirements and wait period after adoption, fees would take effect June 1, 2026.
