PURPOSE:
To consider a Development Agreement for the Come-Together Development with CF Capital Partners, LLC, regarding private parking and landscaping over a City-owned public water main.
BACKGROUND:
The property known as Come-Together Development is located at 5699 Highway 95 North, approximately 2.42 acres, and is zoned General Commercial / Planned Development (C-2/PD). The site consists of six buildings containing a total of 102 units. The development will be served by public wastewater, public water, private roadways, and private drainage systems.
The owner wishes to avoid relocating the existing City-owned public water main and instead place parking and landscaping above it; however, the City must retain access to the water main for operation, maintenance, and repairs. This development agreement is necessary to define the owner’s responsibilities related to City indemnification, resident notifications, coordination, installation of required valves, and restoration of any affected private improvements.
