Action: Resolution No. 25-3859 Approving the Equitable Sharing Agreement and Certification with the United States Department of Justice and Department of the Treasury for Participation in the Equitable Sharing Program (Chief Stirling)

PURPOSE:

To adopt a resolution approving the Equitable Sharing Agreement and Certification for participation in the Equitable Sharing Program.

 

BACKGROUND:

This agreement and certification sets forth the requirements for participation in the Federal Equitable Sharing Program and the restrictions upon the use of federally forfeited cash, property, proceeds, and any interest earned thereon, which are equitably shared with participating law enforcement agencies.  This is an annual reporting requirement.

 

COMMUNITY IMPACT:

Participation in the Federal Equitable Sharing Program allows the Lake Havasu City Police Department to share equitably in the distribution of federally forfeited assets that are seized through the Racketeer Influenced and Corrupt Organizations (RICO) Act.  RICO funding received by the Lake Havasu City Police Department is used to purchase items for law enforcement activities.

 

FISCAL IMPACT:

The use of RICO funding to purchase items for law enforcement activities relieves the General Fund of the burden of these expenses.
