PURPOSE:
The Community Services Department is seeking City Council approval of a professional services agreement with Clarion Associates for review and revision of the Development Code as well as update the General Plan as mandated by state statute.
BACKGROUND:
In 2004 the City contracted with a consultant to rewrite the Development Code. Since then, Staff has implemented several changes through amendments to the code. Now we are experiencing contradictions and conflicting code sections throughout the document. This agreement will review the entire Development Code and provide recommendations for revisions.
Additionally, the City's General Plan was last ratified by community vote in 2002, and is due to be updated. Further, the City has exceeded the 50,000 population threshold in the 2010 Census and therefore, additional elements will be required to be included in the updated General Plan.
COMMUNITY IMPACT:
The work outlined in this agreement will produce a workable Development Code that is consistent with the General Plan and its Future Land Use Map, which will support and guide new development.
Additionally, the Code revisions will provide staff with more flexibility regarding Code Enforcement by developing a new process that is supported by the City Code.
FISCAL IMPACT:
Revenues estimated at $220,000 have been collected through the General Plan Maintenance Surcharge since FY2003. The estimated cost of the General Plan Update is expected to be $216,040. General Fund contingency is requested as this item was not included in the current budget

I move to approve and authorize the City Manager to execute a Professional Services Agreement for the review and revision of the Development Code with Clarion Associates for an amount not to exceed $216,040 utilizing General Fund Contingency.
