PURPOSE:
To consider a Development Agreement for the Villages at Victoria Farms Road with CP LHC I, LLC, regarding private roadways and drainage for the development.
BACKGROUND:
The property known as The Villages at Victoria Farms Road is located at 1800 Victoria Farms Road, includes approximately 54 acres, and is zoned Residential Manufactured Home Planned Development. The site consists of 300 pad spaces, community clubhouse, maintenance building, and mail center. The development will be served with public wastewater, Epcor water, private roadways and private drainage.
Because the development will be served by private roadways and drainage, the developer must enter into a development agreement to address responsibilities associated with the installation and maintenance of these facilities. The development agreement includes the developer’s responsibilities to install and maintain the private roadways and drainage.
The developer will provide a financial assurance for the public wastewater improvements. Receipt of the financial assurance and approval of this development agreement are necessary prior to final plat approval and issuance of permits.
