PURPOSE:

To consider adoption of a resolution approving the Intergovernmental Agreement (IGA) with the Lake Havasu Unified School District for the disclosure of school surveillance video footage in instances of catastrophic health and safety emergency.

 

BACKGROUND:

Recently, the Lake Havasu Unified School District (District) installed a new surveillance system. This IGA is necessary to provide the Lake Havasu City (City) Police Department with surveillance video footage.

 

Under the Family Education Rights and Privacy Act, the District may disclose surveillance video footage to the City’s Police Department under limited circumstances, namely in instances of a catastrophic health and safety emergency.  Under the Act and the proposed agreement, live video feed from District cameras may be shared with the appropriate representatives of the City’s Police Department for the sole purpose of addressing the health or safety emergency.  Catastrophic health or safety emergencies are instances related to an actual, impending, or imminent emergency such as a natural disaster, a terrorist attack, a campus shooting, or the outbreak of an epidemic disease.

 

The term of the proposed Agreement is for ten years beginning on January 1, 2026. 

 

COMMUNITY IMPACT:

This Intergovernmental Agreement outlines the terms necessary to provide surveillance video footage to the City’s Police Department, which will assist in responding effectively to catastrophic health and safety emergencies at applicable District facilities.
