PURPOSE:
To consider the introduction of an ordinance amending City Code Chapter 2.04 to add a new Section 2.04.640, Resignation to Seek City Public Office.
BACKGROUND:
At the September 10, 2024, City Council meeting, the City Council provided consensus to consider an amendment to the City Code regarding resignation to run requirements for City Council appointed board, commission, and committee members.
Two possible scenarios were discussed by the City Council. The first mirrors the State’s resign to run law, which requires that members resign upon the filing of a nomination paper pursuant to Arizona Revised Statutes § 16-314. The second scenario would require a member to resign at the time a statement of interest is filed with the City Clerk.
Each scenario is contained in the attached, tracked ordinance. The new language is represented in ALL CAPS and underlined. The differences between the two scenarios are in bold.
