FUNDING SOURCE:

PURPOSE:

Approve Amendment No. 2 to the Construction Management Professional Services Agreement (500169) with Carollo Engineers, Inc., for the Island Wastewater Treatment Plant Flow Equalization Basin Replacement Project, Project No. 107007, in accordance with City Code Section 3.10.010.2 (A.R.S. Title 34) and 3.10.030.1.

BACKGROUND:

On May 27, 2021, Lake Havasu City Council approved a Professional Services Agreement for Construction Management Services to Carollo Engineers, Inc., in the amount of $254,777 to assist City staff with the construction portion of the project. The scope of work included various tasks such as attending the pre-bid meeting, pre-construction meeting, weekly construction meetings, site visits for special inspections, requests for information, and submittal reviews from the Contractor. They were also hired for Arizona Department of Environmental Quality (ADEQ) Approval of Construction (AOC) assistance and as-built preparations. On March 4, 2022, the City Council approved Amendment No. 1 for additional design services that arose as a result of unknown underground piping encountered during construction and relocation of PLC from the Head Works building to the Electrical building at the City’s request. Amendment No. 1 added an additional $57,692 to the existing contract resulting in an amount of $312,469.

With construction now complete the Consultant is requesting Amendment No. 2 in the amount of $13,000 to cover the additional man-hours required to complete the professional services agreed to previously. Scope did not change but several circumstances arose during closeout that required extensive reviews and more site visits that resulted in additional man-hours provided by the Consultant. City staff agree that the additional hours were warranted and have negotiated in good faith with the Consultant to capture those costs in a reasonable manner. The entire contract with both amendments totals $325,469.

COMMUNITY IMPACT:

The Flow Equalization Basin Replacement Project provides for safety and industry standard updates as well as new storage capacity. Replacement of the existing Flow Equalization Basin is crucial to continue the reliable service of treating wastewater received from the community and to be in compliance with ADEQ. The Flow Equalization Basin is a critical piece of the City’s infrastructure.

FISCAL IMPACT:

Funds in the amount of $13,000 are allocated and available in the Fiscal Year 2024-25 Capital Improvement Program utilizing Wastewater Utility Funds.
