PURPOSE:
To approve a Jail Costs Intergovernmental Agreement (IGA) with Mohave County.
BACKGROUND:
Historically, the City has entered into intergovernmental agreements with Mohave County for jail services in relation to the housing of prisoners arrested by police officers employed by Lake Havasu City. Arizona Revised Statutes § 31-121(D) requires cities to pay for the costs of incarceration in a county jail for prisoners arrested by a peace officer employed by a city and charged or sentenced in a municipal court.
Mohave County made modifications to the IGA that require the parties to enter into a new agreement. Those modifications include: removal of specific rates and fees and adopts by reference rates and fees as set by the Board of Supervisors (A(3) and (13)); added term that County will safeguard personal contact information (A(7)(c)(i)(1)(a)); revised outside medical services (A(7)(b)); added clause about medical clearance (A(15)); revised medical criteria (B(1)); and other housing keeping revisions.
The current prisoner per day charge is $110.61. The one-time intake fee is $91.89.
COMMUNITY IMPACT:
This IGA provides a means of housing prisoners in the Mohave County Jail when necessary.
FISCAL IMPACT:
$810,000 is budgeted for Fiscal Year 2024-25 for Mohave County jail services under this IGA.
