PURPOSE:
To introduce an ordinance amending Article III of Chapter 10.16 of the City Code.
BACKGROUND:
In 2007, the City Council adopted Article III of City Code Chapter 10.16 to regulate the display of vehicles for sale within the Highway 95 corridor. City staff is encountering difficulties with persons parking vehicles for sale, including recreational vehicles, watercraft, motorcycles, and other similar items, upon City-owned or City-controlled property. Some areas are becoming so congested with vehicles for sale that there are few spots for people to park. An example is the parking lot at McCulloch Boulevard and Beachcomber Boulevard on the Island.
In reviewing codes from other municipalities, a prohibition of parking vehicles for sale on all public property is most common. Previously, people were responsive to police officers asking them to move their items for sale, but it is simply becoming too overwhelming and frankly less effective. Additional tools are needed to address this problem.
The proposed ordinance probits a vehicle to be parked or displayed for the primary purpose of advertising the vehicle for sale upon any City-owned or City-controlled property without permission. Vehicle in this section means a motor vehicle, pickup truck, van, watercraft, ATV, motorcycle, recreational vehicle, camper, mobile home, construction equipment, farm equipment, trailer, or similar vehicle. This section will be enforced by the Police Department.
Other housekeeping revisions are suggested to this Article including:
- Correcting a typographical error in Section 10.16.100 (spelling of publicly)
- Revisions making Section 10.16.110 only applicable to Section 10.16.100 and updating Operations Director to Public Works Director
- Adding new Section 10.16.120
- Renumbering Section 10.16.130 and removing reference to a code section that does not exist.
City staff recommends introducing the proposed ordinance.
