PURPOSE:
To adopt a resolution ratifying the City Manager’s execution of Amendment No. 1 to Delegation Agreement with the Arizona Department of Environmental Quality (ADEQ) which would extend the current agreement for another two (2) years.
BACKGROUND:
The ADEQ Delegation Agreements delegate some of its environmental regulatory functions, powers, or duties to a local agency. The current ADEQ Delegation Agreement pertains to issuing permits for open burning. The current ADEQ Delegation Agreement was signed in 2014 with a 10-year term set to expire shortly. ADEQ requested the proposed Amendment No. 1 to extend the agreement for an additional two (2) years, setting the new expiration to May 23, 2026.
COMMUNITY IMPACT:
The continuation of the Delegation Agreement allows for more efficient management of and better service for the open burn permitting process.
FISCAL IMPACT:
No funding is required; the services can be provided with the current staffing structure of the Fire Department at no additional cost to the department or the City.

I move to adopt Resolution No 24-3744 ratifying the City Manager’s execution of Amendment No. 1 to Delegation Agreement with Arizona Department of Environmental Quality for delegation of authority to issue open burn permits.
